Free Speech Freedom Fighter Avery Doninger will get a hearing to appeal her punishment for rallying citizens to support students in their quest to hold a concert that was cancelled by school officials in Regional District 10.
The U.S. Second Circuit Court of Appeals in New York granted Doninger's request for a wide-ranging appeal on July 23. No schedule has been set for the appeal............

the rulings in that case were insane. they were unjust. they were WRONG
this too is VERY wrong (and i'll tell you this much, if one of those boys was MY son, i'd be out for someone's heart on a stick - and i'm NOT a violent woman. NO ONE, NO ONE in a school, makes a child STRIP for ANY reason, unless it's life and death. oh and one more thing. i don't even like kids that much. i just think kids have rights and protections. oh, if they're assholes and troublemakers sure, punish them BUT DON'T STRIP SEARCH THEM UNLESS YOU ARE ALMOST 100% CERTAIN THEY HAVE A WEAPON ON THEM)

Shelton police and state prosecutors say no crime was committed when teachers at the Pine Academy school strip-searched four students. A lawyer for the teens, Robert Berke, says he won’t challenge the findings, but plans to sue, alleging an unreasonable search. Berke says Principal Patricia Nicolari ordered the searches Dec. 2 after a teacher reported $70 missing. He says two male teachers searched the students, making them strip down to their underwear, but the cash wasn’t found. The principal and two teachers were put on administrative leave afterward. It’s unclear if they’re back on the job.

NEW YORK—A federal appeals court ruled Thursday that a high school was within its rights to punish a student for writing critical comments about school administrators on the Internet.

The 2nd U.S. Circuit Court of Appeals said Lewis Mills High School in Burlington, Conn., has a responsibility like any school to teach students the boundaries of socially appropriate behavior.
"Vulgar or offensive speech -- speech that an adult making a political point might have a constitutional right to employ -- may legitimately give rise to disciplinary action by a school," the court said.
Avery Doninger was disciplined after she used derogatory language to describe the administrators in a blog entry she made outside of school in April 2007.
Doninger's mother filed a lawsuit against the school, claiming her daughter's freedom of speech rights had been compromised. A lower court judge ruled that the school acted appropriately in disqualifying her from running for senior class secretary..........

And, in the course of learning about a welfare system for board of education lawyers in Connecticut, citizens might be moved to do something.The Connecticut Freedom of Information Commission issued a finding this week ordering attorney Christine Chinni to produce uncensored billing records for her "work" of behalf of now-retired School Superintendent Paula Schwartz and Lewis Mills Principal Karissa Niehoff. Those records were requested Aug. 1, 2007 and should have been produced then...........

Also, other special guests might show up at the last moment.The event begins at 1 p.m. and includes live music by four high school bands. Hors d'oeuvres, cheese and fruit will be served and there will be a cash bar.Doninger, a senior at Lewis S. Mills High School in Burlington, has civil rights actions pending in the U.S. Second Circuit Court of Appeals in New York City and U.S. District Court in New Haven. She and her mother, Lauren Doninger, sued Principal Karissa Niehoff and Superintendent Paula Schwartz after they removed Avery from the ballot for Class of 2008 secretary.Avery Doninger was among a group of four students who lobbied the community for support of an annual battle of the bands sponsored by the Student Council. Schwartz became very upset after taxpayers called her and she cancelled the event known as Jamfest. Doninger subsequently referred to administrators in a live journal blog as central office douchebags, and Schwartz's son found the posting a couple weeks later. While Avery Doninger was banned from school office, another student who called Schwartz a dirty whore was given an award and lauded for citizenship.School officials suppressed the write-in vote in which Doninger was elected by a plurality. Schwartz refused to accept Doninger's apology for her choice of words. During an assembly, Niehoff banned free-speech and Team Avery t-shirts and seized at least one shirt.The Doningers are seeking -- among other remedies -- an apology for civil rights violations, recognition of the write-in victory and sharing of the secretary position with the administration-backed candidate.U.S. District Judge Mark Kravitz denied a motion for a preliminary injunction and his ruling is being appealed to the Second Circuit...............
